It should also be noted that Yushchenko is planning another political coup against Ukraine's courts immediately following Sundays' election,. Such action is designed to prevent judicial review of the president's decrees and the declaration of the election results.

Olexander Lavrynovych, Ukrainain Minister for Justice, in an an interview published on Aug 3 is quoted as saying “ According to the standards of the Constitution and the laws of Ukraine, these elections should have been recognized invalid already today. But we understand that we speak about the State and about what will happen further in this country. Article 90 of Ukraine's constitution does not give the president the power to dismiss Ukraine's parliament until 30 days have lappsed from the date scheduled for Ukraine's regular parliamentary session. Assuming that the parliament was unable to legally convene its session on September 4 that means Yushchenko has no right to terminate the authority of the parliamentary until October 5. For the sake of 30 days Yushenko has placed the legality of the election at risk of being declared illegal

"The question in the legality of the president's authority to dismiss the parliament is the first and foremost question that MUST be answered. The court should have ruled prior to the election. if the court decides on the basis of law that the president's actions were unconstitutional then the election is nothing more then a very expensive and divisie referendum with not legal status.

"Still, the Constitutional Court has not completed its main mission in the entire early election story. The Court made no decision regarding legitimacy of Mr. Yushchenko’s decree to dissolve parliament and call an early election. The Constitutional Court will have no time to do it before the election and no opportunity to make any decisions after it. "
